Terms + Conditions

 1.  Definitions

“Agreement” shall mean these terms and conditions and the RESTIVAL Booking Agreement between RESTIVAL and the Participant;

“Event Participant” shall mean the client of or individual receiving Booking Services pursuant to this Agreement;

“RESTIVAL” shall mean RESTIVAL LLC, a company licensed to do and doing business in the USA.

“RESTIVAL Booking Agreement” shall mean any agreement entered into by RESTIVAL and the Participant that related to the provision of Booking Services by RESTIVAL;

“Personnel” shall mean the members, employees, agents, and/or representatives of RESTIVAL who are to be engaged in providing the Services;

2.  Provision of Services:

RESTIVAL shall provide the Booking Services to the Event Participant in accordance with the provisions of these Booking Terms and Conditions. All bookings are made directly with RESTIVAL.  By booking a event with us the Event Participant agrees to these Booking Terms and Conditions.  This document constitutes the entire agreement between the Event Participant and RESTIVAL, and your booking will be accepted on this basis.  

Please read the following carefully:

a. Travel Insurance

Restival requires comprehensive travel insurance (see form at bottom of page) for all Event Participants. It is solely the responsibility of the Event Participant to secure such coverage, if he/she chooses to do so. If the Event Participant chooses to obtain travel insurance, RESTIVAL recommends that it cover event cancellations, event interruptions, medical emergencies abroad, emergency evacuation, loss of baggage or personal items and flight delays.  

b. Passports and Visas

Each Event Participant is required to carry a valid passport and obtain all required visas and/or permits for countries visited. All passports must be valid for 6 months beyond the duration of your event.  For example, if the Event Participant (departs/returns) on January 1, his/her passport must be valid until at least June 2.  RESTIVAL is not responsible for travel interruptions or cancellations due to the Event Participant’s failure to obtain or secure proper travel documentation prior to departure.

c. Participant Information

In order to efficiently facilitate RESTIVAL events, RESTIVAL requires specific details from each Event Participant no less than two (2) weeks prior to departure.  Each Event Participant must provide to Restival: (1) his/her full name as it appears in his/her passport, (2) his/her passport number and issue/expiration date, (3) his/her date of birth, (4) nationality, (5) any and all allergies (food or otherwise), (6) dietary preferences, (7) flight itinerary, and (8) any and all pre-existing medical conditions regardless of severity or duration of such condition.  The foregoing information must be submitted to one week prior to departure.  

d. Deposit Requirement

All events require a non-refundable ÂŁ500 deposit to reserve and confirm the Event Participant’s registration for the event.  If booking within 10 days of departure, full payment is due at the time of booking.

e. Event Payment

RESTIVAL offers both incremental payment plans as well as the option to pay in full at the time of booking.  If booking an event more than 30 days prior to departure, all remaining payment is due at least 15 days from departure. If booking within 10 days of departure, full payment is due at the time of booking.

f. Cancellations + Refunds

In the event that a Event Participant wishes to cancel his/her RESTIVAL Booking the following terms and conditions shall apply:

The Event Participant must notify RESTIVAL, in writing, of his/her desire to cancel. The following conditions shall apply with respect to refunds for cancellations:

1.    If the Event Participant cancels 90 days prior to departure, his/her non-refundable deposit is retained, but any other payments already made by the Event Participant will be refunded in full;

2.    If the Event Participant cancels after 90 days of departure, non-refundable deposit as well as all payments made by the Event Participant will not be refunded

Once the deposit is collected, all additional payments are due at least 15 days prior to departure.  RESTIVAL reserves the right to cancel participation resulting in the loss of all money collected if any outstanding payment is not received by 11:59 p.m. on the 10th September.

If RESTIVAL is forced to cancel or significantly alter your event, we will notify the Event Participant in writing as soon as possible.  In these circumstances, the Event Participant may choose any one of the following options:

          1) Accept a credit for the amount you’ve paid towards a future RESTIVAL event; or

          2) Receive a refund of all money paid no later than14 days after the event. 

If, for any reason, the Event Participant leaves a event once it has commenced, RESTIVAL is not obliged to issue any refund, credit, or compensation.

Due to the foregoing cancellation and refund policy, RESTIVAL strongly recommends that each Event Participant purchase travel insurance.

Any complaint that arises as a result of the above cancellation and refund policy, should be directed to the group leader of the event.  If the issue is not resolved and further attention is required, a refund request must be directed to RESTIVAL in writing within 30 days of last day of the event.  Whether a Event Participant is entitled to any refund, credit, or other form of compensation for his/her complaint, is within the sole discretion of RESTIVAL.

g. Optional Activities

Throughout the course of each event there will be opportunities to participate in additional and optional activities including but not limited to hiking, and guided walking tours.  The dangers associated with these activities as well those generally inherent to the event location are accepted by the Event Participant at his/her own risk. Any assistance given by group leader or local representative in organizing these activities shall not result in any liability of RESTIVAL for any bodily injury, illness, or death arising out of, resulting from, related to, and/or caused in whole or in part, by the Event Participant’s involvement in these optional activities.

h. Age and Health Requirement

Event Participants must have reached the age of 15 at the time of departure.  Any Event Participant under the age of 18 (at the time of departure) must be accompanied by an adult.   

RESTIVAL’s events are adventurous and can be physically demanding.  It is the sole responsibility of the Event Participant to choose a event that fits his/her personal level of physical fitness, which requires awareness of any personal physical and mental limitations.  RESTIVAL strongly suggests that Event Participants research or look into any and all pertinent information with respect to the latest health requirements and recommendations for the destination.  This includes obtaining all necessary vaccinations, inoculations and prescription medications as directed by a local doctor or clinic.  

i. Photography

By agreeing to RESTIVAL’s Booking Terms and Conditions, the Event Participant gives RESTIVAL permission to use photos taken of him/her during the events for promotional purposes and in any other medium RESTIVAL chooses.  

j. Code of Conduct

Each of the RESTIVAL destinations have cultural customs unique to each region including attire, food, drink and other social aspects.  Though RESTIVAL will provide cultural information on each location but it is recommended that Event Participants research on his/her own as well to ensure all Event Participants are prepared.  RESTIVAL does not tolerate illegal drug use and respectfully asks that each Event Participant of age to do so, consumes alcohol responsibly.  RESTIVAL reserves the right to remove a Event Participant from a event is he/she is found to be engaging in and/or using any illegal activity or drug and/or hazardous behaviour. Such removal shall be at the Event Participant’s own financial expense.

k. Acceptance of Risk

RESTIVAL wants each traveller to experience an unforgettable adventure of discovery, both personal and cultural.  Therefore, RESTIVAL’s events involve an inherent degree of personal risk based on cultural, political, and geographical attributes relevant to our destinations.  RESTIVAL gathers information from foreign departments and our own local contacts to make itinerary decisions; however, it is ultimately the Event Participant’s responsibility to familiarize himself/herself with relevant travel advisories and information.   By booking a event with RESTIVAL, the Event Participant acknowledges that he/she is aware of associated risks with such unique travel and agrees to release, indemnify, and hold harmless RESTIVAL from any and all liability and responsibility arising out of, resulting from, related to, and/or caused in whole or in part, by bodily injury, illness, or death, whether such was the result of intentional or unintentional acts.

l. Forum and Governing Law

By agreeing to these RESTIVAL Terms and Conditions, the Event Participant acknowledges that he/she is contracting with a business incorporated in the USA. This Agreement shall be interpreted and construed according, and governed by, the laws of the United States of America excluding any such state or international laws that might direct the application of the laws of another jurisdiction.

m. Severability

Invalidity or unenforceability of one or more provisions of this Agreement shall not affect any other provisions of this Agreement. If possible, any unenforceable provision within this Agreement will be modified to reflect the parties’ original intent.

n. Updating of Booking Terms and Conditions

RESTIVAL reserves the right to update or alter these RESTIVAL Booking Terms and Conditions unilaterally at any time and it shall be the Event Participant’s responsibility to familiarize himself/herself with them.
